By accessing this website we assume you accept these terms and conditions. Do not continue to use Amanda Meryle Photography if you do not agree to all of the terms and conditions stated on this page.
1. Definitions
- Client: The individual or business entity who engages the services of the Photographer.
- Photographer: Amanda Meryle Photography and its representatives providing photographic services.
- Services: Photographic services offered by the Photographer.
- Agreement: This terms and conditions document.
2. Services
- The Photographer agrees to provide the photographic services as described on www.amandameryle.com.au
- Services may include, but are not limited to, event photography, portrait sessions, milestone sessions, commercial photography, and image editing.
3. Booking and Payment
- A booking is considered confirmed only upon receipt of a non-refundable deposit of $350 which covers all initial costs including your Session Guide and other information
- The remaining balance is due 7 days prior to your photo shoot or as otherwise agreed in writing.
- Payments can be made via bank transfer or credit card using the online system where available
4. Cancellations and Rescheduling
- If the Client cancels after receiving the Session Guides and other information and/ or less than 7 days before the scheduled date, the deposit will be forfeited.
- Rescheduling requests must be made at least 7 days in advance and are subject to the Photographer’s availability.
- In the event of illness rescheduling is at the discretion of the Photographer and is subject to availability. There will be no charge if this happens once. Any subsequent rescheduling requests may incur a fee or the session may be cancelled and the deposit forfeited, at the discretion of the Photographer.
- In the event of unforeseen circumstances, the Photographer reserves the right to reschedule the booking.
5. Copyright and Usage
- The Photographer retains the copyright to all images created during the session.
- The Client is granted a non-exclusive, non-transferable license to use the images for personal use only, unless otherwise agreed in writing.
- The Client may use images for marketing and promotional purposes for their own business or brand excluding the uses listed below.
- The images must not be sold, used in competitions, distributed to third parties, or used to gain profit in any way other than promotional purposes without written agreement.
6. Delivery of Images
- Images will be delivered to the Client within 2 weeks of the shoot date, unless otherwise specified.
- Delivery will be made via online gallery unless otherwise specified
- The Photographer is not responsible for any delays caused by third-party services.
7. Liability
- The Photographer will take all reasonable care to ensure the satisfaction of the Client.
- In the unlikely event of total photographic failure or other unforeseen circumstances, the Photographer’s liability shall be limited to a refund of any fees paid.
- The Photographer is not liable for any damages, loss of profits, or other claims arising out of the use or inability to use the images.
8. Model Release
- The Client agrees that the Photographer may use any images taken during the session for promotional purposes, including but not limited to advertising, social media, and portfolio display.
- The Client will not receive any compensation for the use of these images.
9. Governing Law
- These terms and conditions shall be governed by and construed in accordance with the laws of Victoria, Australia
- Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia
10. Amendments
- The Photographer reserves the right to amend these terms and conditions at any time without prior notice. Any changes will be posted on www.amandameryle.com.au
